What Happens After You Are Arrested?If you are arrested, the police may take you to the county jail or city police department for booking. During your booking, the police may take your fingerprints and photo, check your criminal history, and run you for in-state or out-of-state warrants. You may be released with a Court date where you must appear or hold you to be seen by a judge for a bond. If you receive a bond, you will need to post that bond through cash or a corporate surety (meaning a bail bondsman).

What is an Arraignment?Your arraignment is the first appearance after your arrest or bond hearing. In Arkansas, you must appear in person at your arraignment unless otherwise excused. In some instances, an experienced criminal defense attorney can handle your arraignment for you without you having to appear. At your arraignment you will learn the nature of the charges against you and your constitutional rights. You will have the opportunity to enter a plea of guilty or not guilty, but our attorneys always enter a plea of “not guilty” so that we can learn the evidence the police and prosecutors have and develop a defense. You may be given conditions of release in addition to your bond, including possibly a no-contact order.

What is the Difference Between a State and Federal Charge?State charges are violations of state law and are prosecuted in the Arkansas state court system. State charges are typically more common. Federal criminal charges are violations of federal law and are prosecuted in the U.S. Attorney’s office through the federal court system. Defendants may face federal charges after being investigated by the Federal Bureau of Investigation (FBI) or other similar agencies.

Can a Warrant be Removed?Warrants can be issued for a couple of reasons. Police will investigate a crime that is reported, and if they develop what is called probable cause, they can ask a judge to issue a warrant to arrest a person they believe committed a crime. Warrants may also be issued if an individual does not comply with a court order, attend their court hearing, complete the terms of their probation, or pay a fine. In order to clear a warrant, a person must turn themselves in to the jail or police department in person to have the warrant served and be given a Court date.
